Terms of service

1. The agreement

By creating an account or using EnergyFlow you accept these terms. If you use it on behalf of a company, you confirm you are allowed to bind that company, and “you” means the company. A separate signed agreement with us, if there is one, takes precedence over these terms where they differ.

The service (energyflow.ro) is provided by DEVOPS TEAM SRL, Str. Complexului nr. 3, Carcea, Dolj, Romania, fiscal code RO35610990, Trade Register J16/276/2016.

2. The service

EnergyFlow collects data from solar inverters, batteries, meters, chargers and similar equipment through the platforms and gateways you connect, and turns it into dashboards, forecasts, alarms, recommendations, reports, owner pages and optional automations. We improve the service continuously, so features may change; we will not remove a core feature you pay for without reasonable notice.

Forecasts, diagnoses and recommendations are estimates based on the data available to us. They support — but do not replace — the judgement of a qualified professional. Any work on electrical installations must be done by authorised personnel in line with applicable regulations.

3. Accounts

• Give accurate information and keep it up to date.
• Keep your sign-in details secret and tell us straight away if you think your account has been misused.
• You are responsible for what happens under your account, including by colleagues you invite.

4. Connected platforms

When you connect an inverter or device platform you authorise us to access it on your behalf and confirm that you have the right to do so — for example because you own the system or the owner has agreed. Those platforms are run by third parties under their own terms. We are not responsible for their availability, accuracy or changes to their interfaces, and a vendor may limit or withdraw access at any time.

5. Device control and automation

Some features can change how equipment behaves (for example starting an EV charger or adjusting a battery setting). You decide which devices and rules to enable, and you are responsible for making sure they are safe and suitable for the installation. Automations depend on networks and third-party platforms and can be delayed or fail; do not rely on them for safety-critical functions. You can disable any automation at any time.

6. Acceptable use

You must not:

• access systems or data you are not authorised to access;
• interfere with, overload or try to break the security of the service;
• reverse-engineer the service, except where the law allows it;
• use the service to break the law or the terms of a connected platform;
• resell the service without our written agreement.

We may suspend access if necessary to stop a serious breach or protect the service, and will tell you why.

7. Your data

You keep all rights to the data you and your equipment bring into EnergyFlow. You give us the right to use it to provide, secure and improve the service, including to train our detection models on aggregated or pseudonymised data. We may use anonymous, aggregated statistics that do not identify you, a site or a person. You can ask for an export of your data at any time and for its deletion when you leave.

8. Data processing

Where you enter personal data about others (such as system owners), you are the controller and we are your processor. We will: process it only on your documented instructions (these terms and your use of the service); keep it confidential; secure it appropriately; use sub-processors only under equivalent obligations (listed in our Privacy notice, with notice of changes so you can object); help you respond to data subject requests and meet your security, breach-notification and impact-assessment obligations; notify you of a personal data breach without undue delay; delete or return the data when the service ends; and make available the information needed to demonstrate compliance, including reasonable audits. You are responsible for having a legal basis for the data you give us and for informing the people concerned. A signed data processing agreement is available on request.

9. Fees

Prices and billing terms are agreed with you before any charge applies. Unless stated otherwise, prices exclude VAT and invoices are payable within 30 days.

10. Availability

We aim for the service to be available at all times but cannot guarantee uninterrupted or error-free operation. Planned maintenance will be announced where possible.

11. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for wilful misconduct or gross negligence, or any liability that cannot be limited by law. Otherwise, and to the extent the law allows: we are not liable for indirect or consequential loss, including lost energy yield, lost revenue or savings, or damage resulting from third-party platforms or automations you configured; and our total liability in any 12-month period is limited to the fees you paid us in that period.

If you use EnergyFlow as a consumer, you also keep all the rights that consumer protection law gives you.

12. Ending the agreement

You can stop using EnergyFlow and close your account at any time. We may end the agreement with 30 days' notice, or immediately for a serious breach. When the agreement ends, access stops and your data is deleted as described in the Privacy notice, after giving you the chance to export it.

We may update these terms. We will notify account holders by email at least 30 days before a material change takes effect; if you do not agree, you can close your account before then.

13. Law and disputes

These terms are governed by Romanian law. Disputes will be settled amicably where possible, and otherwise by the competent courts of Craiova, Romania — without taking away any right a consumer has to go to the courts where they live. Consumers can also use the ANPC alternative dispute resolution service (anpc.ro).
